Four former U-M football players suing NCAA, Big Ten Network over NIL

10 September 2024 at 15:08

Four former University of Michigan football players are suing the NCAA and Big Ten Network over money made off their Name, Image and Likeness, court documents confirm.

In a class-action lawsuit filed in U.S. District Court Eastern District of Michigan Tuesday morning, Braylon Edwards, Denard Robinson, Mike Martin and Shawn Crable, on behalf of former University of Michigan football players who played 2016, are seeking more than $50 million for being "unlawfully denied" the ability to make money when they were student-athletes.

The suit states that the NCAA and Big Network have made money off of plays made by the four players, as well as other former players, in commercials and other promotional material. The suit describes that promotional material as "broadcasting, advertising, and selling merchandise featuring their performances." without their consent on financial compensation. The players claim they are entitled to a present and future share of any revenue generated from the use of their publicity rights."

The 73-page lawsuit brought by attorney Jim Acho is on behalf of former Michigan football players who played before 2016. Those players are seeking "to right a wrong perpetuated on college athletes for decades."

College athletes have been able to earn NIL money since July of 2021 and the ruling included players dating back to 2016. Former college athletes have filed similar suits, including a suit filed involving promotional material used in March Madness promos.

We have reached out to the NCAA and the Big Ten Network for comment on the suit. The NCAA said they did not have a comment at this time, and the Big Ten Network has not yet gotten back to us.

Union workers at Detroit Marathon refinery go on strike

4 September 2024 at 09:48

Union workers at Detroit's Marathon Oil refinery have gone on strike, effective this morning (Wednesday, Sept. 4).

WATCH BELOW: Marathon refinery union workers speak on why they are striking Striking worker at Detroit Marathon refinery speaks on strike Worker on strike at Marathon Detroit refinery: 'I'll stay out here however long it takes'

Teamsters Local 283 tells us that this comes following several months of negotiations and mediation, with the union workers claiming that 'Marathon has been unwilling to bargain fairly with the Teamsters.' The Union workers are demanding pay increases and improved schedules in their negotiations.

This strike comes after the teamsters' contract expired on January of this year, with Teamsters authorizing a strike with a 95 percent vote.

Teamsters Local 283 includes more than 800 workers, including board operators, field operators, chemists, laboratory technicians, electricians, and mechanics.

We are essential workers that work around the clock to ensure the plant keeps running and keeps making Marathon money, said Jeff Tricoff, a relief operator at Marathons Detroit refinery in a press release. Marathon has made record profits for the last few years by ramping up production and cutting costs, but we dont want our contract to be a part of their cost cutting efforts. Our role in Marathons success should be rewarded with a strong union contract that includes competitive wages and fair language to increase work life balance and morale in the plant.

According to the Marathon Detroit Refinery website, the refinery has a crude oil refining capacity of 140,000 barrels per calendar day.

"The refinery processes sweet and heavy sour crude oils into gasoline, distillates, asphalt, fuel-grade coke, chemical-grade propylene, propane and slurry," the website reads.

Below is a statement from Marathon Petroleum Corp.:

On September 4, hourly employees represented by Teamsters Local 283 commenced an economic strike at Marathon Petroleums Detroit refinery, in support of the unions bargaining proposals. We are disappointed that the union has decided to engage in a strike. Marathon Petroleum and the union have engaged in collective bargaining since December 4, 2023, meeting regularly for the last nine months to achieve a new labor agreement to replace the prior agreement that expired on January 31, 2024. The company has negotiated in good faith, but the union thus far has been unwilling to agree to acceptable terms for an agreement and, instead, has decided to engage in a strike in support of its bargaining positions. We are fully prepared and have implemented plans to continue safely operating the facility with trained and qualified Marathon employees, and a safe and orderly handover to these experienced team members has been completed. The safety of our employees, contractors and the community remain our top priority, and we are committed to maintaining our vigilant focus on compliance, reliability and care for the environment as we continue producing transportation fuels for the region; we do not anticipate supply disruptions.

OU Faculty could strike Tuesday as negotiations with school continue

1 September 2024 at 20:25

After failing to come to a deal in recent talks with the University, Oakland faculty have informally voted to authorize a strike and could strike the day before classes start on Tuesday, Sept. 3.

The union and the school are set to speak again on Tuesday before a mediator. If no deal is reached by the end of that session, OU teachers could go on strike just before the 2024-25 school year starts.

This comes after more than 300 OU faculty members met Friday to start the strike authorization vote, with teachers fighting for higher wages.

WATCH OUR PREVIOUS COVERAGE: Oakland University and faculty at odds over contract as school year set to start Oakland University and faculty at odds over contract as school year set to start

The Oakland University American Association of University Professors (OU-AAUP - AFT Local 6762) met with university officials earlier today for hours, with the union telling us they made an economic proposal that administration did not agree to.

Whats at stake isnt about getting faculty large gains, says union spokesperson Phyllis Ness in a press release. At this point its about trying to make sure we dont fall any further behind. According to the union, OU faculty make about 25% less than their colleagues nationwide.

The union says that the two sides are in disagreement when it comes to salary increases for full-time and part-time faculty, with another point of contention being a lack of any retirement contributions for part-time faculty.

When asked for comment, the university sent us the following statement:

At todays bargaining session, the University unconditionally withdrew all of its proposals onfaculty workload by agreeing to the faculty unions last proposal on that article of theagreement. Therefore, workload will no longer be discussed at the bargaining table and will notbe an impediment to a new agreement. The parties also tentatively agreed to four other articles and an appendix, including increases tofaculty travel, research funds, and raises for faculty promotions. The primary issue remaining is compensation for full-time faculty and part-time speciallecturers. The faculty union rejected the Universitys economic package of a total increase of21% over five years, which includes an increase of 16% to base salaries over five years plus anadditional 1% in one-time bonus payments. In contrast, the faculty union insists upon an economic package of a total increase of 30% overfive years, which is neither feasible nor sustainable.Bargaining is scheduled to continue Tuesday, Sept. 3, when the sides meet again with the state-appointed mediator. The University remains committed to finalizing a new agreement in timefor the Fall semester to start as planned Sept. 4.

Man sleeping on Ann Arbor train tracks hospitalized after getting hand stuck in train

27 August 2024 at 12:08

A 20-year-old man who had been sleeping on train tracks in Ann Arbor was hospitalized after getting his hand stuck in an incoming freight train, according to officials.

The incident reportedly happened around 9:30 p.m. on Monday, with first responders dispatched to the Ann Arbor Railroad Tracks between East Huron Street and Miller Avenue.

Officials say firefighters found the young man on the tracks, and say that that a northbound train ran over him. According to a post by the city's Fire Department on Facebook, the train was "traveling at a very slow speed and was able to stop within a relatively slow distance" once it's driver realized a person was under the train.

Authorities say the man's left hand was caught in the rear axle of the lead locomotive, pinning it between the wheel, axle and rail gear, with the man laying in between the rails of the track.

"Shockingly, the hand injury was the only major trauma," the fire department said in the post.

The department says it took a while to get the man out from under the train due to the strength of the metal and where the man was located on the tracks. The Ann Arbor Police Department eventually drove out with a surgical team to prepare for a possible field amputation, but the man was able to free in just under two hours.

After he was freed, the man was transported to the hospital, where he is in stable conditions.

"This was a once in career incident for those involved," the department said in the post. "Normally, person versus train incidents are fatal. This was a true team effort."

The agencies that assisted the Ann Arbor police department for this endeavor include:
